I have been thinking that the wave of marriage equality sweeping across the eastern seaboard might convince the California Supreme Court Justices that it's not a scarily-radical-activist thing to put the validity of their original decision over a barely-there majority. It now doesn't seem like such a bitter pill that they're giving to the evangelical crowd, it seems more like keeping up with the times.

I still wish we'd had somebody who'd argued the thing better in the first place, though. I wasn't happy with what I'd heard of the arguments made, and I'm not entirely sure the argument got across that the difference between an amendment and a revision should be the contradiction of something in the main body of the constitution (ie the right to marriage that they found last year) vs something new that was never clarified in prior language.

There is a feeling that the Court was leaning against overturning Prop 8, but now that events have overtaken them, that they HAVE to lean the other way.
